Your use of the Site constitutes your unqualified, unconditional and irrevocable agreement to accept and comply with these Site Terms of Use. We grant you a non-exclusive license to use this Site strictly in accordance with these Site Terms of Use. We reserve the right to revoke this license and prevent you from using this Site (or any of its services) at any time without giving you a reason.

In particular you agree that you will not: a. make any unauthorised, false or fraudulent booking or any booking in anticipation of demand; b. use this Site in a manner which causes or may cause an infringement of the rights of flynas and/or of any third parties; c. post, transmit, or disseminate any information on or via the Site which is, or may be, harmful, obscene, defamatory or illegal; d. attempt to interfere with the operation or functionality of this Site including, without limitation, uploading, downloading or transmitting corrupt files or computer viruses or other harmful material, or using any software, routine or device to interfere with the Site; e. take any action that causes an unreasonable or excessively large load on the infrastructure of the Site; f. obtain or attempt to obtain unauthorised access to the Site, including access through the false use of a password or personal identification number, or attempt to misrepresent your identity or authority to act on behalf of another; g. proxy or mirror without Our prior written permission; or h. violate these Site Terms of Use in any other manner. We reserve the right to cancel your Booking(s) without reference to you and/or deny you access to this Site where We believe, in Our discretion, that you are in breach of any of these Site Terms of Use.

GENERAL CONDITIONS OF CARRIAGE

These Site Terms of Use refer only to your use of this Site, any carriage by air using a Booking obtained using this Site shall be subject to Our Terms and Conditions of Carriage and our Carrier’s Regulations, and may also be subject to the Warsaw Convention or the Montreal Convention which may limit the carrier's liability in certain circumstances. Separate conditions apply to prize draws, competitions or other promotions which We may run from time to time.

WARRANTIES, DISCLAIMERS AND LIMITATION OF LIABILITY

Whilst We use reasonable efforts to include accurate and up-to-date information on the Site, errors may occur. Your access to and use of the software and content on this Site is entirely at your own risk and access is provided "as is" and on an "as available" basis only. To the maximum extent permitted by law We accept no liability for the content of the Site and all implied warranties, including, but not limited to, the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy are excluded from these Site Terms of Use. We cannot give any warranty or representation as to the accuracy of the information and do not accept responsibility for errors or omissions or for any action or decisions based on the information. We do not warrant that the Site will be available uninterrupted or error free or that any defects will be corrected. Save as otherwise stated in these Site Terms of Use and to the full extent permitted by law, We do not accept any liability for any direct, indirect, special, consequential, punitive or exemplary losses or damages of whatever nature arising out of: a. access to, or the use, of this Site; b. delay or inability to use this Site; or c. the information contained in this Site; including, but not limited to loss of profits, anticipated savings, revenues, data, goodwill or contracts resulting from contract, tort (including negligence) or whatever cause. Nothing in these Site Terms Of Use excludes Our liability for death or personal injury directly resulting from Our negligence or in respect of fraudulent misrepresentation or liabilities not permitted to be excluded by applicable law.

INDEMNITY

As a condition of using this Site, you agree to indemnify, and keep indemnified, Us, against all liabilities, claims, losses, costs, damages and expenses including legal fees incurred by Us should you breach any of these Site Terms Of Use. Whilst We try to keep Our anti-virus software up-to-date We do not warrant that the Site, its servers, downloadable files or e-mails which may be sent by Us, are free from viruses or other harmful components. d. statistical and marketing analysis, operation of frequent flyer programmes, customer surveys, customer relations, updates about the Site and Our products and services and identifying your requirements and preferences;
e. to enable you to participate in competitions and offers for certain products and services which may be of interest to you, unless you inform Us otherwise; or
f. for website administration systems testing, maintenance and development (including enabling Us to respond to any comments on the Site or feedback you may give Us). If you do not wish to receive certain newsletters and other mailings from Us relating to Our own products and services and those of organisations with whom We have a strategic relationship, you may opt-out by ticking the relevant boxes on the Site or by sending Us an email at [email protected].
